Pooch Airways – Passenger Terms (Public/Shared Charter Booking Agreement)

When you purchase a seat on a Pooch Airways flight, a contract is formed between you and Pooch Airways, and each party has certain rights and obligations as set forth below. Please read these terms carefully.

1. General

Pooch Airways is operated by JBL Global Charter Inc. (the “Public Charter Operator” or “Pooch Airways”), with an office at 6726 NW 72 Ave, Miami, FL 33166, United States.

The price of your trip, flight dates (outbound and/or return, if applicable), origin and destination cities, and other conditions are as specified in the applicable itinerary, flight brief, and/or your accepted reservation, all of which are incorporated into these terms by reference.

Unless otherwise specified in writing, the price includes only air transportation and the services explicitly listed in your itinerary.

2. Reservations & Payments

Reservations are made directly with Pooch Airways. After receiving your reservation request, we may review passenger identification details and pet details to confirm suitability for travel and manifest requirements.

Your reservation is not confirmed unless and until full payment has been received and your reservation is accepted by Pooch Airways.

If there is an issue with your travel details, identification, or pet details, you will be notified by email that your reservation was not accepted. If your reservation is not accepted, any payment collected by Pooch Airways for that reservation will be returned in accordance with applicable law and payment processor rules.

Payment processing may be completed through third-party payment processors. You authorize Pooch Airways and its payment providers to charge the payment method provided for the total amount due.

3. Air Transportation

Pooch Airways is not a direct air carrier but arranges shared charter flights operated by FAA Part 135 licensed air carriers.

Flights are operated by a duly licensed air carrier using aircraft selected by the operator (the “Operator”). The Operator supplies air transportation subject to all applicable laws and regulations governing the provision of commercial air transportation.

Pooch Airways and the Operator reserve the right to substitute another duly licensed carrier and/or to change the aircraft type, capacity, routing, and/or crew as operationally required. No refund will be given solely for such substitutions or changes.

Flight dates and times are not guaranteed and may change due to operational or safety requirements, including weather, air traffic control, maintenance, crew availability, and other circumstances.

4. Check-In Information

Please refer to your itinerary/flight brief for check-in location and timing. Unless otherwise stated in writing:

  • Passengers must arrive and present themselves for check-in at least 60 minutes prior to scheduled departure.
  • If you are not present at the boarding area at least 30 minutes prior to scheduled departure, you may be considered a “no-show.”

If you are a no-show, your seat may be released. In such event, neither Pooch Airways nor the Operator shall be responsible for your transportation, and no refund will be due.

5. Cancellations by Pooch Airways and Major Changes

Because shared charter flights are demand-driven and subject to operational constraints, Pooch Airways may need to cancel or modify flights in limited circumstances.

5.1 Cancellation More Than 28 Days Before Departure

Pooch Airways reserves the right to cancel a trip for any reason provided we notify you in writing no later than 28 days before the scheduled departure date. If we cancel under this section, we will refund amounts paid for the cancelled flight within a reasonable period, typically within 14 days.

5.2 Cancellation Less Than 28 Days Before Departure

Pooch Airways will not cancel a trip less than 28 days before departure except for circumstances that make it physically impossible to perform the trip, including safety and operational reasons. If such a circumstance occurs and the trip is cancelled, we will refund amounts paid for the cancelled flight within a reasonable period, typically within 14 days.

5.3 “Major Changes”

If Pooch Airways makes a pre-departure “Major Change,” you may cancel up to 24 hours before departure and receive a refund of amounts paid for the affected service within a reasonable period, typically within 14 days. Only the following constitute a “Major Change”:

  • (i) A change in the departure or return date (a delay of longer than 48 hours will always be considered a Major Change);
  • (ii) A change in the origin or destination city; or
  • (iii) A price increase of more than 10% occurring 10 or more days before departure.

If a Major Change occurs after your outbound flight has been completed and you do not accept it, Pooch Airways will refund the portion of your payment that applies to the service not provided within a reasonable period, typically within 14 days after the scheduled return day (if applicable).

6. Cancellations by Passenger, Itinerary Changes, and Refunds

ALL SEATS ARE NON-REFUNDABLE ONCE BOOKED.

If you cancel or change a reservation, including during the period we are processing your reservation, no refund will be due unless Pooch Airways does not accept your reservation.

If you “no-show” for a flight, this will be treated as a passenger cancellation and no refund will be due.

In limited circumstances, if a passenger provides a substitute participant utilizing the same itinerary, Pooch Airways may, at its sole discretion, allow substitution. If substitution is approved in writing by Pooch Airways, any credit or refund (if offered) may be subject to an administrative fee. Substitution is not guaranteed and may be denied due to manifest, security, regulatory, or operational requirements.

7. Amenities in the Event of Flight Delay

Pooch Airways shall have no responsibility for, and shall have no liability for failing to, provide amenities in the event of a flight delay. Pooch Airways may provide, in its sole discretion, hotel accommodations, meal vouchers, ground transportation, or other amenities to passengers inconvenienced by a delay.

8. Baggage Allowance and Liability

Baggage allowances may vary by aircraft and route and will be specified in your flight brief. All baggage is subject to weight-and-balance limitations and Operator safety requirements.

Overweight or oversized luggage may be refused or carried subject to load restrictions and possible additional charges.

Pooch Airways and the Operator do not accept liability for lost, delayed, or damaged baggage except as required by applicable law and any applicable Operator contract of carriage or tariff.

9. Responsibility and Liability

Pooch Airways is responsible for arranging the services included in the trip as described in your itinerary. Airlines and other suppliers are independent contractors over whom Pooch Airways has no control.

Accordingly, except as otherwise provided herein, Pooch Airways is not responsible or liable for any loss, injury, expense, damage to property, sickness, injury, or death to you or any animal that results directly or indirectly from:

  • (a) an act or omission of any air carrier, Operator, or third-party supplier; or
  • (b) any cause beyond the direct and immediate control of Pooch Airways.

You are responsible for any damage to the aircraft caused by you or any animal you transport on a flight, and you shall indemnify and hold harmless Pooch Airways from any such damage.

Where applicable, international carriage may be subject to the Warsaw Convention and/or the Montreal Convention, including applicable limitations on liability.

10. Identification and Travel Documents

UPON BOOKING YOU MUST SUBMIT A COPY OF YOUR GOVERNMENT-ISSUED PHOTO IDENTIFICATION AND BRING THIS WITH YOU ON THE DAY OF TRAVEL.

This identification must match the passenger manifest. Failure to provide correct identification may result in delayed departure or denial of boarding, and no refund will be due.

You are responsible for obtaining all necessary travel documents (passport, visas, tourist cards, immunization certificates, and any other documents required) and for complying with the laws of each country from, through, or to which you receive transportation.

You agree to indemnify Pooch Airways for any loss, damage, or expense incurred due to your failure to comply with this section.

11. Force Majeure

Pooch Airways shall have no liability for any failure or delay in performance due to Force Majeure, meaning events beyond reasonable control, including but not limited to: acts of God, natural disasters, epidemics/pandemics, crew illness, terrorism, civil unrest, war, sanctions, governmental actions, fires, explosions, adverse weather, air traffic control restrictions, utility failures, supplier non-performance, and labor disputes.

If a flight cannot be performed or completed due to Force Majeure, Pooch Airways’ sole obligation will be to refund amounts paid in connection with a cancelled flight, unless prohibited or altered by applicable law or Operator requirements.

12. Pet Safety and Travel Requirements

Pooch Airways is pet-friendly and allows in-cabin pet travel, subject to safety requirements.

  • Pets must be vaccinated, in good health, and fit to fly.
  • Pets must be well behaved and under the control of the owner at all times.
  • Dogs must remain on leash when required by airport rules and safety instructions.
  • Cats must remain in an appropriate carrier when required by the Operator or crew.

Pooch Airways and/or the Operator may require safety equipment (including muzzles) based on the specific pet, route, or operational circumstances. If required, failure to comply may result in denied travel, and no refund will be due.

If a pet is noted as potentially aggressive or unsuitable at booking, Pooch Airways may request additional information and may require an assessment by a veterinarian or qualified partner at the passenger’s sole expense.

13. Pet Documentation for Travel

If the destination you are traveling to requires pet documentation, compliance is the responsibility of the owner. Pooch Airways may provide referrals or resources, but Pooch Airways is not responsible for your compliance.

Pooch Airways may request copies of required pet documentation before departure and may share documents with relevant parties for operational planning or pre-clearance where applicable.

Failure to supply correct pet travel documentation may result in denied travel, and no refund will be due.

You agree to indemnify Pooch Airways for any loss, damage, or expense incurred due to your failure to comply with this section.

14. Notices

All notices and communications should be sent by email to info@poochairways.com. Notices to Pooch Airways are effective upon actual receipt.

15. Applicable Law

This contract is governed by and shall be construed under the laws of the State of Florida, without regard to conflict of law principles. Any disputes shall be brought in courts located in Florida, unless otherwise required by applicable law.

16. Miscellaneous

Pooch Airways reserves the right to amend these terms at any time by posting an updated version on our website. The rights and remedies provided are in addition to any other rights and remedies available under applicable law; however, acceptance of a refund furnished under this contract may constitute a waiver of other remedies to the extent permitted by law.

To the fullest extent permitted by law, Pooch Airways shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages in connection with this agreement, whether in contract or tort (including negligence), including loss of revenue, loss of use, or anticipated profits.

17. Insurance

Trip cancellation, health, and accident insurance may be available from third-party vendors. Options can be provided upon request. Pooch Airways does not sell insurance and is not responsible for third-party insurance products.

18. Operational Control and Captain’s Authority

The Operator is responsible for the operation of the aircraft and the safe performance of each flight and retains full operational control and possession of the aircraft. The captain of the aircraft has absolute discretion as to when and whether any flight should be undertaken, whether the aircraft should be landed, and whether any passenger, baggage, animal, or cargo should be refused.

Passenger agrees to accept decisions made by the captain and waives claims against the Operator and Pooch Airways arising from such decisions, except that Pooch Airways’ sole liability shall be to refund the portion of the price allocable to services not provided, if and to the extent required by law.

If a passenger is refused entry at an arrival airport, passenger shall indemnify and hold harmless Pooch Airways for liabilities, costs, expenses, damages, and losses incurred in connection with arrangements made to return the passenger.

20. Passenger Acknowledgement and Electronic Acceptance

By booking a flight with Pooch Airways, the Passenger confirms that they have read, understood, and agree to the following documents:

  • Pooch Airways Passenger Terms
  • Booking & Cancellation Policy
  • Passenger Agreement & Pet Liability Waiver
  • Privacy Policy

Passenger acknowledges that acceptance of these terms may be provided electronically during the booking process and that such electronic acceptance shall constitute a legally binding agreement.

Passenger further acknowledges that they are responsible for ensuring that all passengers included in the reservation understand and agree to these terms.

Chargebacks and Payment Disputes

By completing a reservation with Pooch Airways, you agree not to initiate a credit card chargeback or payment dispute for reasons covered under these Terms, including but not limited to:

  • Passenger cancellations
  • No-shows
  • Schedule adjustments
  • Aircraft substitutions
  • Operational delays
  • Flight changes permitted under these Terms

If a chargeback is initiated in violation of these Terms, Pooch Airways reserves the right to pursue recovery of all costs associated with the dispute, including administrative fees, legal costs, and collection expenses.
